I cannot commend them enough for their rigorous patience and perseverence, which ultimately found me not guilty.
James has a vast knowledge of the law, and knows how and when to use his robust array of resources. At no point did I question his tactics on defending my case.
Any time you are involved in a scenario like a DUI, the consequences will be life changing. It will cost you, both financially and personally. There is no way to avoid this. I feel that the time and money spent on selecting Jay to represent me were well spent. I would reccomend him to anyone facing the daunting reality of an OUI.

Let me begin by stating I have a Very unique case history, in that I have been Charged & Convicted of (3) three DUI 1st Offenses.
October 1997, Framingham, MA
September 2011, Rhode Island
July 2013, Middleton, MA’
And I should inform you, that in all (3) cases I failed a Field Sobriety Test and Breathalyzer Test.
Following the 2013 case, being convicted of only a 1st Offense and sentenced to 90-Day Suspended license, and installation of a Breathalyzer device, I proceeded to the DMV to apply for a “Hardship”/” Cinderella License. I was told to have the ignition device installed and to come back with the appropriate paper work. When I returned, I was told the DMV story changed, they stated that my License would probably be suspended for (8) Years, Looking back at all Three Convictions.
I immediately contacted my attorney from my latest case (2013 Middleton) Martin Kane. Martin not handling many DUI cases at the time referred me to Jay Milligan, and called him a “DUI Miracle Worker”.
Attorney Milligan looked over my unique case and immediately had a plan of action. He told me he was going to attempt to get my 1997 Conviction Vacated. I know what you are thinking and I was thinking the same thing, HOW THE HELL is he going to do that? I Failed the Sobriety Test, I failed the Breathalyzer Test, what did he have to work with? Attorney Milligan proceeded as planned despite my disbelief and Filed A MOTION FOR A NEW TRIAL. Apparently, the paperwork from my 1997 Arrest had a BOX that stated “I had the right to a Jury Trial”, that Box was left UNCHECKED by the Judge. This unchecked Box got our foot in the door for a new trial.
Next, we WAITED, 6-8 months for the Judge that presided over my 1997 case to RETIRE. You know what they say “Timing is Everything”. After the Judge’s retirement Attorney Milligan and his team submitted the paperwork for the New Trial, and 6-8 months later the new trial was granted. Attorney Milligan was even more confident, so confident that he believed the STATE would Drop All Charges before the court date. That was not the case. When the state was asked to produce the key witness, The Arresting Officer they could not do so. Remember it has been 19 Years since the arrest, the arresting officer has retired to Florida and refused to travel back to Massachusetts to testify. Result, CASE CLOSED, ALL CHARGES DROPPED! As if it never happened, I can’t tell you how many times I wished I had a Time Machine, and could go back and Erase that mistake (And a few others). Now I had a Time Machine and his name is Attorney Jay Milligan.
Now with the 1997 Conviction ERASED from my record, it’s time to schedule a hearing with the DMV to reinstate my driving privileges.
I was arrested and charged with third offense OUI and leaving the scene after causing property damage. I was devastated over the five year license loss for refusal of the breath test and the possibility of five months mandatory jail time with an additional eight years loss of license. Hiring the right attorney was one of the biggest decisions of my life. After doing some research, Jay Milligan had the most experience and best reputation. After our first consultation, I felt like he was the right guy and his fees were fair given the severity of the case. Throughout the process of going to trial, Jay and his team fought for me every step of the way, including challenging the 5 year suspension for my refusing the breath test, which we won and I got my license back during the pendency of the case, this was a very unique bonus. The real challenge was wining at the trial. My honest opinion about Jay after sitting in the defense chair watching him at trial is he is truly very experienced, aggressive and takes his work very seriously. It was clear he had my best interests in mind and truly cared. The district attorney also took this very seriously and was pushing back with multiple police witnesses and civilian witnesses. Throughout the cross examination of these witnesses Jay was able to open and punch holes through their testimony. Getting to the Trial took a long time and I knew it could go either way for me, but I was also confident because I knew that Jay was prepared and we had done everything we could have done to win the case. I was found not guilty on both charges after a jury trial. I would recommend Jay and his team to anyone without hesitation in this kind of serious position. Their professionalism and experience in this area surpasses any OUI attorney out there and the results of my trial speak for themselves.
2 words.... Case Dismissed!
When you go through the legal process you spend a good deal of time in the courtroom and observe a lot, this reaffirmed to me that I made a very wise decision in choosing Jay for my representation. I can’t say enough about how strongly I recommend Jay Milligan. He is well respected in the courts by the DA’s office, his fellow attorneys, the clerks, employees of the court and the judges. His courtroom demeanor is exceptionally polished.
I had a difficult case that included a police report with some alleged incriminating statements I had made at the time of my arrest. Jay from the very start had a strategy that included filing a motion to suppress evidence to get the Officers who wrote the report on the stand under oath. Jay worked through most of the items he wanted to suppress with the DA but there was one outstanding item they needed to argue. During the motion hearing he was able to site case law to the Judge, she was going to give him time to respond back to her with the case law, which was unnecessary because Jay knew the law off the top of his head. This ultimately resulted in a favorable outcome on that portion of my case. He was also able to walk through the police report and alleged statements I made with the officers under oath during the motion hearing. This was critically important to the outcome of my case.
We took my case to Jury trial, throughout the process Jay advised me of the options, the pros and cons. He went through my testimony several times to ensure I was prepared. He did the same with my witness. I knew what to expect at trial from reviewing the potential jurors to how the trial would unfold. At trial Jay was able to expose one of the officers who testified had already testified differently previously under oath (from the motion hearing) and had a transcribed copy of the testimony which he had the officer read out loud to the jury. After Jay’s questioning the other officer agreed that his observations could have been the result of the airbag deployment (my arrest came as a result of a car accident). We were prepared with a timeline of the day, extensive documentation to support the timeline and how the day unfolded. Jay was prepared, like able and factual. The end result was a Not Guilty verdict by the jury. I can’t thank Jay enough for his impeccable representation.
In my opinion, Jay Milligan is with no doubt one of New England’s top DWI, DUI, and OUI attorney’s in our area. Drunk driving defense is his specialty. Jay is board certified in drunk driving and has been defending clients for the past 15+ years. He is very knowledgeable in the law and comfortable being in a court room. Jay’s extensive knowledge of the Law’s allows him to provide his clients with the best possible outcome for each person’s situation. I strongly recommend anyone with an OUI or DUI to contact Jay or his office to handle their case. That said, I would like to give some hope to the folks out there who have lost their license due to five or more DUI’s and have a lifetime indefinite suspension on their license. You may want to discuss your past convictions with Jay to see if any of them are worth challenging for a dismissal. The law is not perfect and makes mistakes too. This could mean the difference between never being able to drive again and regaining your right to drive. There are no guarantees, but I can tell you that in my son’s case, by me making that call to Jay, was one of the greatest gifts I could have ever gave him. I called Jay and asked him if he would review my son’s past convictions and he said he would. We only needed to win one conviction for my son to drive again. Well, Jay reviewed them and today my son has his driver’s license back and is able to provide an easier living for his family. No more worrying about things like how he’s getting back and forth to work each day, etc. It has changed his life as well as his families just by me making that call.

Throughout the process, Jay was always responsive whenever I called or emailed. I even called him the night before my trial in the evening because of a concern I had and he not only picked up my call, but greeted me by name.
When my trial date came, he was right by my side. He told me what was going to happen and what to do. Jay is a competent and professional attorney who helped me through a difficult time. 8. Well after the trial was over, his office responded to my requests for additional information.
My son, who is a reporter, accompanied me to my pre trial and trial. He has had the opportunity to view and hear many court cases. He said, “Dad, you picked a great lawyer. He is smart, asks great questions and seems to be personally invested in providing you with a good outcome.” As I sat and watched the proceedings while waiting in the courtroom for my trial to begin, I became aware that Jay Milligan possesses a burning desire to do his best for the clients he represents.
Jay understands how difficult it is to deal with getting a DUI. Depending on the facts, and your circumstances, I’m sure Jay can offer you the best advice to mitigate possible monetary or freedom penalties. Attorneys with his skills in the Boston area, demand a much higher fee for services. This man is highly skilled in his chosen craft.
I am very satisfied that Jay earned every single dollar and more that I paid him to help me deal with the legal issues I faced. Ending up in handcuffs is a very traumatic experience for many of us who try to follow the rules and be good citizens.
